BUILDER RULES AND INFORMATION

Master Association - All residents will be part of the Master Association. Dues will be $195.00 annually. Builders must inform buyers of Master Association and dues.

Sub-Association - All neighborhoods must have a sub-association in order to have voting rights and representation at Master Association level.

Community Watering System - Sub-associations with common area maintenance will be required to use The Lakes irrigation system. The system will utilize lake water.

Architectural Control Committee - All builders will submit plans and receive a blanket approval, thereafter, alterations will need approval by the ACC.

Repair or Replace Curb, Sidewalk or Trail - Sidewalks or curbing damaged during construction must be repaired or replaced by builders. The City of Blaine and the developer will have a walk through when construction is complete. Areas needing repair or replacement will be designated and replaced at that time. Thereafter, it will be the builder's responsibility.

Builder Signs - During construction and marketing, all builders must use the same signs, which have been approved by Developer along all parkways. Builders may use their own signs within their neighborhoods. Weekend directional signs must also be approved by Developer if used on parkways.

Neighborhood Monuments - Neighborhood monuments must be paid for by the builders. Monument designs have been provided from which to choose. Upkeep of monument will be by master association.

Swimming Pools - All pools must be in-ground and must be fenced. Developer makes no guarantees as to suitability of soils for pool construction.

Sodding - All units must be entirely sodded within 30 days of completion of unit. If unit is completed after Nov. 1. and before May 1, it must be sodded by June 15th.

Mailbox - All neighborhoods must use a uniform mailbox design and cluster where possible.

Rubbish - All builders must use the recycling program set up by the Developer.

Fencing - Maintenance free fencing only will be approved, and will only be allowed in rear yards unless approved by ACC. Fencing must closely match samples provided for master approval. Maximum height on fences shall be 48". (Fencing rear yards of lake lots shall not be in the buffer easement, please review the additional standards in the Lake Management Plan.)

Concrete - All builders to create a concrete dump lot for truck cleanout and ultimately move the concrete and block to the central recycle area.

Trees - Each lot shall contain one front yard tree and one boulevard tree, with a minimum of 2-1/2 caliper inch. Front yard may be over story deciduous shade tree or a six foot tall conifer. Corner lots shall have one additional boulevard tree. Lots with rear yards on the 5 large bodies of water shall have a minimum of 1 rear yard tree.

Lake Management Plan - Developer will provide builders and buyers with a Lake Management Plan, which will incorporate special grading on rear of all lake lots. The plan also includes seeding by the Developer of the rear 25 ft. of all lots on water, which must be maintained by builders. (See Management Plan) Silt fence will be installed on uphill side of 25 ft. environmental area. Also, builders must inform buyers of all rules and regulations as they pertain to lake use, such as, docks, non-internal combustion motors, lift stations, storage of exterior equipment, etc. Builders must have buyers sign off that they have received the Lake Management Plan. Builders and buyers must adhere to Management Plan or Declarant may repair or replace non-confirming area and bill builder or buyer for the work.

Fema - The Lakes is in a Fema Flood Zone. Pioneer Engineering will process Fema paperwork to remove from flood plain after an as built survey is done. If Pioneer Engineering stakes lots for construction, they will do so as part of the process.

Soils - All front yards and house pad areas have been corrected. Rear and side yards have not been corrected to accommodate general building construction or pools. Notify your buyers that additional correction may be required to stabilize the soils before additional construction could occur.
